THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.2212 of 2015 ORDER:

This criminal revision case is filed under Sections 397 and 401 Cr.P.C., challenging the order dated 12.8.2015 in Crl.M.P. No.5906 of 2014 in C.C. No.133 of 2011 on the file of the Court of Judicial Magistrate of First Class, Kanigiri, wherein and whereby the trial court dismissed the petition filed under Section 239 Cr.P.C..

The petitioners are A3 to A6 and the first respondent is de facto complainant in C.C. No.133 of 2011.

When the matter is called for hearing, learned counsel for the petitioner and the learned counsel for the first respondent, in one voice, submitted that the criminal revision case may be disposed of by dispensing with the presence of the petitioners before the trial court. In view of the said submission, this court is inclined to dispose of the criminal revision case, without going into the merits of the case.

Accordingly, the presence of the petitioners-A3 to A6 before the trial court in C.C. No.133 of 2011 on each and every date of adjournment is dispensed with. However, they shall appear before the trial court as and when their presence is so required. 5.

With the above direction, the criminal revision case is disposed of. Miscellaneous petitions if any pending in this Crl.RC shall stand closed.
