Heard learned counsel for the petitioner and the learned Government Pleader for Social Welfare (TG) appearing for respondent Nos.1 to 4.

On the complaint made by respondent Nos.5 and 6 herein, the Agency Divisional Officer, Kothagudem, respondent No.2 herein, initiated enquiry under the Andhra Pradesh Scheduled Areas Land Transfer Regulations and passed an order of ejectment against the petitioner herein and another vide L.T.R. Case No.15/2015/Chg, dated 07.10.2016, in respect of the land admeasuring Ac.9.16 guntas situated in Sy.No.101/LU of Utupalli Village, Chandrugonda Mandal, Bhadradri Kothagudem District. Aggrieved by the said order of ejectment, according to the petitioner, he filed a statutory appeal before respondent No.1/The Additional Agent to the Government, Bhadradri Kothagudem District, Bhadrachalam on 07.09.2017 and also filed two applications, one to condone the delay in filing the appeal and another for stay.

The grievance of the petitioner, as advocated by the learned counsel for the petitioner, is that no orders have been passed on the said applications and in view of the same, the respondent authorities are actively contemplating to dispossess the petitioner herein from the subject property.

Admittedly, the petitioner herein filed the appeal with a delay. In the facts and circumstances of the case and having regard to the submissions made by the learned counsel for the petitioner and taking into account the submissions of the learned Government Pleader, this Court deems it appropriate to dispose of the present writ petition with a direction to respondent No.1/The Additional Agent to the Government at Bhadrachalam, Bhadradri Kothagudem District to pass appropriate orders on the application for condonation of delay, dated 07.09.2017, said to have been filed by the petitioner herein along with the appeal within a period of four (4) weeks from the date of receipt of a copy of this order after hearing all the stakeholders. It is also further directed that basing on the same, further action can be taken. Till the application for condonation of delay is disposed of, status quo with regard to the subject property shall be maintained.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
