Heard Sri A.Jagannadha Rao, learned counsel appearing for the

petitioner and the learned Government Pleader for Civil Supplies.

2. It is submitted by the petitioner in his writ petition that the respondents have entrusted the fair price shop to a temporary dealer for distribution of the essential commodities to the card holders on the ground that the petitioner was running the fair price shop through a benami dealer. Nowhere in the Affidavit filed in support of the petition it is mentioned that the authorisation of the fair price shop of the petitioner was suspended.

3. The learned Government Pleader for Civil Supplies submitted the instructions received by him which show that the authorisation of the petitioner was suspended and a show cause notice was also issued to him.

4. In the circumstances, the writ petition is disposed of with a direction to the 2nd respondent-RDO, Vizianagaram, to conduct an enquiry into the allegations mentioned in the show cause notice and pass final orders within a period of 8 (eight) weeks from the date of receipt of a copy of this order. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs. ___________________ R.KANTHA RAO, J.
