P. Gandharam Naidu Anand v. The Presiding Officer, Industrial Tribunal-Cum-Labour Court
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21541 OF 2002 ORDER :
When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and the petitioner is challenging the orders passed by the Industrial Tribunal in I.D.No.92 of 1999, dated 18.1.2002, wherein no relief was granted by the Industrial Tribunal. The petitioner was challenging the orders of removal before the Industrial Tribunal. The petitioner is seeking a direction to set aside the orders of removal and reinstate him into service. At this point of time, the relief sought for by the petitioner to reinstate him into service cannot be granted. Therefore, this Court is of the considered view that the Writ Petition can be disposed of directing the respondents to pay the service benefits for the service rendered by the petitioner prior to removal, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. 2.
With this observation, Writ Petition is disposed of. 3.
The Miscellaneous Petitions pending, if any, shall stand closed. _________________________________ ABHINAND KUMAR SHAVILI, J 10th December, 2018 GS
