This civil revision petition is filed by the defendant in the suit aggrieved by the non-disposal of IA No.353 of 2015 in OS No.77 of 2008 filed for extension of time for payment of suit costs as per the directions passed in IA No.1873 of 2009.

Petitioner's counsel states that the IA is not being disposed of by the Court below and furnished the details of the dates on which the matter was adjourned in the grounds of revision. Ground no.5 of the grounds of revision is thus:- "5.The petitioner humbly submits that the matter is adjourned for counter on 22-6-2015, thereafter, it is coming for enquiry on 9-7-2015, 11-8-2015, 14-9-2015, 14-10-2015, 22-01-2015, 22-032016, 22-04-2016, 22-07-2016, 29-08-2016, 16-11-2016, 16-022017, 16-03-2017, 21-04-2017, 28-06-2017, 20-12-2017 and finally posted to 20-02-2018. In all these days the matter is coming for enquiry and Court below neither disposed of the IA nor stopped proceedings in execution petitions."

In the circumstances, it is expedient that the Court below dispose of the IA as expeditiously as possible, in any case not later than six weeks from the date of receipt of a copy of this order, in accordance with law on its own merits and this Court has not expressed any opinion on the merits of the matter. 4.
The civil revision petition is disposed of accordingly.
Miscellaneous petitions, if any pending shall stand closed. No order as to costs.
