The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in considering the representation dated 21.10.2008 made by the petitioner seeking payment of salary from 22.05.2008 to 01.05.2009, duly treating the period as on duty, as illegal and arbitrary and violative of Articles 14 and 16 of the Constitution of India. 3.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to consider the representation dated 21.10.2008, made by the petitioner, at the earliest. 4.

Learned counsel for respondents would submit that subsequent to the said representation, the petitioner also filed an application seeking alternate employment and as such the request of the petitioner need not be considered. However, it is stated that if the said representation is pending consideration, the same may be directed to be disposed of, in accordance with law. 5.

Having regard to the above rival submissions made and without going into merits of the case, the present writ petition is disposed of directing the second respondent to dispose of the representation dated 21.10.2008, made by the petitioner, seeking payment of salary from 22.05.2008 to 01.05.2009, if not already considered, in accordance with law, at the earliest. There shall be no order as to costs. 6.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
