HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.1879 of 2018 ORDER :

Heard learned counsel for the petitioners in the criminal petition seeking to quash the proceedings in C.C.No.893 of 2017 on the file of the IX Additional Chief Metropolitan Magistrate, Hyderabad, taken cognizance for the offences punishable under Section 420 IPC and Sections 6 and 7 read with 19 of the Seeds Act, 1966 and Section 7 of the Essential Commodities Act, 1955 and also learned Public Prosecutor, representing the State for respondent, and perused the grounds in the quash petition vis-à-vis the police final report, First Information Report and Part-II Case Diary material. 2.

From perusal of the material, there is nothing for this Court to interfere, but for left open by filing a discharge application to urge all points if at all no grounds to frame any charge for any of the specific offence, for the learned Magistrate to consider. 3.

So far as the difficulty expressed for all to appear concerned, the petitioners are given liberty, by virtue of this order, to file application under Rule 37 of the Criminal Rules of Practice for one to represent the others, the trial Court to consider after hearing with necessary conditions including of personal appearance as and when required.

Accordingly, the criminal petition is disposed of, without prejudice to all defence since left open.
