THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.5073 of 2018 Order:
This Writ Petition is filed challenging the endorsement dated 02.11.2016 passed by the fourth respondent rejecting the request of the petitioner for issuance of pattadar passbooks and title deeds in respect of the land of an extent of Ac.1.15 cents, situated in Survey No.455-2 of Chilamathur village, Lepakshi Polam, Ananthapuram District. The impugned order of the fourth respondent says that the land for which pattadar passbooks and title deeds claimed is an assigned land. Whereas, learned counsel for the petitioner submits that on the false report submitted by the fifth respondent, the said conclusion was arrived at and the revenue records clearly show that the land purchased by the petitioner is an ancestral land.
If that is so, since there is a provision for appeal against the impugned order, this Court is not inclined to entertain the present Writ Petition, but gives liberty to the petitioner to file an appeal against the impugned order and, as and when such appeal is filed, the appellate authority shall pass appropriate orders in accordance with law by taking into consideration the documentary evidence produced by the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
