THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.2114 of 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner seeking a direction to the learned XI Additional District & Sessions Judge, Tenali, for expeditious disposal of Crl.R.P.No.114 of 2017 pending before it, which is preferred against the order, dated 02.08.2017, passed in M.C.No.55 of 2013 by the learned II Additional Judicial Magistrate of First Class, Tenali.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

It is contended that the Enforcement Application to enforce the order, dated 02.08.2017, passed in M.C.No.55 of 2013 by the learned II Additional Judicial Magistrate of First Class, Tenali, is filed and is pending consideration. Without there being final adjudication of the Criminal Revision Petition No.114 of 2017 pending on the file of the learned XI Additional District & Sessions Judge, Tenali, it is not appropriate to proceed with the Enforcement Application. 4.

No doubt, it is the right of the petitioner to get an early disposal of Criminal Revision Petition No.114 of 2017 on the file of the learned XI Additional District & Sessions Judge, Tenali. The very maintenance order in M.C.No.55 of 2013 by the learned Magistrate is under challenge in the aforementioned Criminal Revision Petition.

Therefore, in the interest of justice, a direction can be given to the Court of Sessions to dispose of Criminal Revision Petition pending before it, expeditiously.

Accordingly, the learned XI Additional Sessions Judge, Tenali, is directed to dispose of Criminal Revision Petition No.114 of 2017 pending before him/her, within a period of three (03) months from today.

The Criminal Petition is disposed of accordingly. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
