This appeal is filed under Order 43 Rule 1(r) read with Section 151 CPC challenging the orders dated 05.07.2006 in I.A.No.1425 of 2005 in O.S.No.2294 of 2005 on the file of the Court of IV Senior Civil Judge, City Civil Court, Hyderabad. 2.

Heard the learned counsels appearing for both parties. 3.

At the time of arguments, learned counsel for the appellants submitted that the trial Court may be directed to dispose of the main suit without being influenced with the orders dated 05.07.2006 in I.A.No.1425 of 2005. 4.

In view of the submission made by both the counsel, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the C.M.A. is disposed of directing the learned IV Senior Civil Judge, City Civil Court, Hyderabad to dispose of the suit O.S.No.2294 of 2005 on merits without being influenced by the observations, if any, made in the orders dated 05.07.2006 in I.A.No.1425 of 2005. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
