HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.13995 OF 2007 ORDER:

The writ petition is filed questioning the initiation of the land acquisition proceedings dated 09.02.2007, issued under the Land Acquisition Act, 1894 (for short, "the Act, 1894"). The brief facts of the case, according to the petitioner so far as they are relevant for the purpose of disposal of this writ petition are that the 1st respondent initiated the land acquisition proceedings with regard to the lands Ac.2.16 cents, Ac.0.60 cents and Ac.7.24 cents situated in Sy.Nos.471/1A, 471/2A and 475/1 respectively.

The contention of the learned counsel for the petitioner is that the notification was issued against a dead person. The writ petition was admitted on 03.07.2007 and interim stay was granted on that day.

Today, when the matter came up for hearing, learned Government Pleader for Land Acquisition passed on the written instructions received from the Tahsildar, Bhimavram dated 01.12.2017 addressed to the Sub Collector, Narsapur, wherein it is stated that already an extent of Ac.81.77 cents of land was acquired vide Award dated 3.7.2008 in Gunupudi Village for providing plots in G+3 buildings to 9500 families to the Urban Houseless poor. It is further stated that the present market value of the land is Rs.4,000/- per sq. yard which comes to Rs.93,60,000/- per acre. Accordingly, the total value of the land will be very high as the estimated cost of the land in this case is very high and burden to the Government exchequer. It is also

stated that it will not be feasible to continue the land acquisition proposal.

In view of the written instructions of the Tahsildar, Bhimavram dated 01.12.2017 addressed to the Sub Collector, Narsapur, no further orders are required to be passed in this matter.

Accordingly, the writ petition is closed. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
