HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6822 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioners in D.V.C.No.6 of 2011 on the file of the Judicial Magistrate of First Class, Godavarikhani. The 2nd respondent is the wife of the 1st petitioner and petitioners 2 and 3 are in-laws and petitioner No.4 settled the alliance between the 2nd respondent and the 1st petitioner. The 2nd respondent, aggrieved by the harassment made by the petitioners, approached the Court below by filing the aforesaid D.V.C. Earlier, the 2nd respondent filed W.P.No.26507 of 2010 before this Court seeking a direction against respondents 1 and 2, i.e,. Superintendent of Police, Medak District and Station House Officer, Siddipet I Town P.S., in interfering with her personal life. There was a direction by this Court to respondents 1 and 2 therein, not to interfere with the personal life and liberty of the 2nd respondent herein, i.e., Smt.Afreen, unless and until there is a crime registered against her.

Since the matter pertains to D.V.C., it requires a fair trial in the interest of the 2nd respondent herein and, therefore, this Court is not inclined to interfere with the matter.

The criminal petition is, accordingly, dismissed, granting liberty to the petitioners to invoke appropriate proceedings under law. As a sequel, miscellaneous petitions if any pending stand closed. ______________________ T. AMARNATH GOUD, J October 13, 2017 MRR
