Smt. Tumuku Satyavathi v. The Sub - Registrar,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.28558 of 2012 ORDER :
Heard the counsel for petitioner, and the learned Government Pleader for Revenue, for respondents.
2.
The 4th respondent herein had earlier filed WP.No.21741 of 2010 before this Court challenging the refusal of 1st respondent in registering sale deeds in respect of plot admeasuring 700 Sq.Yds. in Survey No.88 Part covered under Block No.1, situate at Petbasheerabad, Quthbullapur Mandal and Municipality, Ranga Reddy District, allegedly belonging to her.
3.
Initially, on 10.11.2010, in the said Writ Petition, this Court directed the 1st respondent to receive and register sale deeds in respect of the said land stating specifically that it would be subject to the result of the Writ Petition.
4.
Ultimately, the said Writ Petition came to be dismissed on 24.04.2012, granting liberty to the 4th respondent to approach the competent Civil Court for remedy.
5.
The petitioner has therefore filed the present Writ Petition stating that in spite of the said interim order specifically stating that the registration, if any, would be subject to the result of the Writ Petition and that the said Writ Petition being subsequently dismissed,

the respondent nos.1 and 2 have not cancelled the sale deeds presented by the 4th respondent.
6.
The petitioner herein claims that she purchased the above plot under a sale deed dt.19.06.2000 and also obtained construction permission from the Greater Hyderabad Municipal Corporation on 07.09.2007, but the husband of the 4th respondent fabricated an unregistered agreement of sale - cum - General Power of Attorney and on that basis filed WP.No.21741 of 2010. She therefore contended that on coming to know of the fraud by the 4th respondent, she got herself impleaded in WP.No.21741 of 2010, and ultimately the Writ Petition was dismissed on 24.04.2012. She further contended that several documents were registered by the 1st respondent at the instance of 4th respondent, and in view of the order dt.24.04.2012 all those documents need to be cancelled.
7.
The learned Government Pleader for Revenue, appearing for respondents, has placed before me proceedings dt.15.04.2017 of the 1st respondent addressed to the 2nd respondent seeking permission to cancel the documents.
8.
On 15.04.2017, the 2nd respondent has directed the 1st respondent to implement the order dt.24.04.2012 in WP.No.21741 of 2010. He further stated that the cancellation of these documents is reflected in the statement of Encumbrance of property in respect of

the said land, though there is no specific order about the cancellation passed by the 1st respondent.
9.
Since the Court order dt.24.04.2012 in WP.No.21741 of 2010 has thus been implemented by the 1st respondent by canceling the documents executed by 4th respondent in respect of the subject property, the grievance of petitioner herein is thus redressed, and no further orders are required in the present Writ Petition. 10.
Accordingly, the Writ Petition is closed. No order as to costs. 11.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
