HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 35535 of 2012 ORDER:

Challenging the action of respondents in not promoting the petitioner to the post of Senior Assistant, the present Writ Petition is filed. The petitioner also sought for consequential relief directing the respondents to promote him to the post of Senior Assistant with all consequential benefits from the date of eligibility, by upgrading/reviving the existing post of Junior Assistant in Seethanagaram Group o f Temple, Tadepally Mandal, Guntur District etc.

When the matter is taken up for consideration, it is brought to the notice of this Court that the Deputy Commissioner, Endowments Department, Guntur, second respondent herein, way back on 20.10.2011 addressed the Commissioner, Endowments Department, Andhra Pradesh, at

Hyderabad recommending to upgrade the existing sanctioned post of Junior Assistant as Senior Assistant with retrospective effect from 18.06.1993 and promote the petitioner to the post of Senior Assistant by giving notional promotion in the upgraded post of Senior Assistant and sought for necessary orders in regard thereto. Even after lapse of five years, no orders have been passed by the Commissioner-first respondent. In the circumstances, the Writ Petition is disposed of directing the first respondent to issue necessary orders pursuant to the proceedings of the second respondent in Rc.No. B3/6564/2011, dated 20.10.2011 within a period of three months from the date of receipt of a copy of this order. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
