THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6206 of 2020 ORDER:
This Writ Petition is filed for the following relief: "....to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in interfering with Petitioners possession as being arbitrary illegal violative of principles of natural justice and in gross violation of Article 14 and 300A of The Constitution of India apart from being in gross violation of Judgments passed by this Hon'ble Court."
Heard learned counsel for petitioners.
Sri Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC), appearing for respondent No.3, would submit, on instructions, that certain complaints have been received stating that the petitioners are proceeding with the unauthorized construction in the subject site, as such, the authorities of Hyderabad Metro Development Authority as well as GHMC have inspected the same. He would also submit that the respondent authorities would not take action against the petitioners in respect of the subject site without passing appropriate orders and without providing opportunity to the petitioners.
CKR, J W.P.No.6206 of 2020 In those circumstances, placing on record the aforesaid submission of the learned Standing Counsel for GHMC, this Writ Petition is disposed of. It is made clear that as long as the construction of the petitioners is in accordance with the sanctioned plan, the respondents shall not interfere and obstruct such construction without following due process. Miscellaneous applications, if any pending, shall also stand closed. There shall be no order as to costs.
