HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.21075 OF 2008 ORDER:

The petitioner seeks a writ of mandamus declaring the action of the 1st respondent in not disposing of the revision petition filed by him as against the order passed in C.M.A.No.87/03, dated 02.07.2005, by the 3rd respondent as illegal, arbitrary and consequently, to dispose of the revision petition.

Petitioner's case is that at the instance of petitioner's vendors, one Irpa Krishna, filed a complaint before 2nd respondent under Section 3 of A.P. (Scheduled Areas) Land Transfer Regulation 01 of 1959 and its Amendment Act 01 of 1970 and the said complaint was registered as L.T.R. Case No.71/97/BPD and the 2nd respondent passed an order dated 24.08.1994, ordering the ejectment of the petitioner and some others, who are respondents in the said case. Aggrieved, the petitioner filed C.M.A.No.87/03 before the 3rd respondent and the same was dismissed by order dated 02.07.2005. Aggrieved, the petitioner filed revision before the 1st respondent and the same is not disposed of, though it was filed in the year 2008. Therefore, prays for necessary orders.

In view of the above submission of learned counsel for petitioner, this writ petition is disposed of directing the 1st respondent to dispose of the revision petition filed by the writ petitioner, if already not disposed of, within twelve weeks from the date of receipt of a copy of this order, by affording opportunity of hearing to all concerned. Till disposal of the revision petition, the status quo order passed by this Court on 25.09.2008 shall hold good. No costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
