SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.10403 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in C.C.No.43 of 2007 on the file of Judicial First Class Magistrate at Bodhan, registered for the offences under Sections 406 and 420 IPC, against the petitioner/A7. 2.

Heard learned counsel for petitioner/accused and learned Public Prosecutor for the first respondent. None appears for the second respondent in spite of service of notice. 3.

Learned counsel for the petitioner submits that since the name of the petitioner was not mentioned in the complaint, the proceedings against her need to be quashed.

A perusal of the charge sheet shows that A1 to A5 have created fake registration numbers of the vehicles at the xerox shop of petitioner/A7. There is also a specific allegation that A6 and A7 have created fake RC of the lorry in dispute, at their colour lab, by colluding with A1 to A5. In view of the said allegations, this Court opines that it cannot be safe to quash the proceedings against the petitioner/A7.

Hence, the Criminal Petition is dismissed. However, at request of the learned counsel for the petitioner, the presence of petitioner/A7 is dispensed with before the trial Court and the trial Court is directed not to insist the presence of the petitioner unless

her presence is necessary. Miscellaneous applications, if any, TR,J Crl.P. No.10403 of 2011 pending in this criminal petition shall stand dismissed. ___________ T. RAJANI, J 10th September, 2018.
