THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40533 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in not granting recognition/affiliation to the petitioner as a valid body for the sport of Archery for the State of Telangana including by not considering the representation dated 10.06.2016 as illegal and arbitrary and consequently to direct the third respondent to recognize and grant recognition/affiliation to the petitioner as valid and proper body for Archery in the State of Telangana.
Heard and perused the material.
Learned counsel for the petitioner submits that though the representation seeking recognition/affiliation was submitted on 10.06.2006, no orders are passed by the third respondent till now. He further submits that there is a Sports Meet on 13.12.2016 and in view of the non-disposal of the representation, dated 10.06.2016, the members of the petitioner Association may not able to participate in the said Sports Meet. Hence, he prays this Court to direct the third respondent recognize the petitioner as valid Archery Association in the Talangana State. Considering the facts and circumstances of the case, the third respondent is directed to dispose of the representation, dated 10.06.2016, on or before 08.12.2016. It is made clear that if no orders are passed by 08.12.
2016, the third respondent is directed to allow the members of the petitioner Association to participate in the Sports Meet to be held on 13.12.2016. The third respondent is at liberty to take decision on the basis of the merits of the representation. This Order will not stand in the way of the third respondent in taking decision based on the merits of the case. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 23.11.
