HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.7903 OF 2007 ORDER:
Learned counsel appearing for the parties submit that the prayer in the instant writ petition is similar to the prayer in W.P.No. 6173 of 2007 and was disposed of as follows:
"It is represented by both the learned counsel that this writ petition is filed seeking relief in relation to NABARD's Circular No.172/PCD-15/2006 dated 19/10/2006 and this Court considered the identical issue in WP.No.1817 of 2007.
2. The order dated 10/2/2011 passed in WP.No.1817 of 2007 reads as under:
"At the hearing, Smt. Bobba Vijaya Lakshmi, learned counsel for the petitioner, stated that in pursuance of the interim order, dated 02/2/2007, the debt relief package was given to the petitioner and that therefore the cause in the writ petition does not survive for adjudication.
In view of the above submission, the writ petition is dismissed as infructuous."
3. In the light of the above, both the learned counsel submitted that the same order may be passed. Learned counsel for the petitioner made a further request that the petitioner may be given liberty to approach the competent court or avail any other remedy in the event, he has any further grievance in the matter.
4. In view of the above, this writ petition is disposed of in terms of the order dated 10/2/2011 in WP.No.1817 of 2007, with the liberty to the petitioner to approach this Court or to avail remedy as may be necessary, in future.
2. Writ Petition No.7903 of 2007 is disposed of as indicated above. No order as to costs.
3. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
