N.Venkateswarlu v. Deputy General Manager (Works),
THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.3289 of 2003 Date:08.02.2016 Between:
N. Vekateswarlu ... Petitioner.
AND The Deputy Gneral Manager (Works), Government Regional Press, Vijayawada and others.
...Respondents.
The Court made the following:
THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.3289 of 2003 ORDER:
This writ petition is filed questioning Award dated 16-10-2001 in I.D.No.81/1996 on the file of Presiding Officer, Labour Court, Guntur.
2. Petitioner herein referred the dispute to labour Court contending that his services were terminated with effect from 29-06-1992 and the same is illegal. The labour Court, on a consideration of material, held that the applicant worked for 100 days only from July 1991 to June 1992 and he has not fulfilled the requirement of 240 working days in the preceding 12 months prior to 29-06-1992 and that his contention with regard to termination is not correct. It is further held
as petitioner has not worked for 240 days, he is not entitled for the benefits under Section 25 (f) of Industrial Disputes Act.
3. When this matter has come up on 30-11-2015 on the request of Advocate for petitioner, one week time was granted and again from 09-12-2015, 07-01-2016, 19-01-2016 & 29-01-2016, the matter was adjourned only on the request of petitioner's counsel. In spite of taking number of adjournments, no interest is evinced to proceed with the case. Today neither Advocate for petitioner is present nor any representation is made on behalf of the petitioner. It seems that the petitioner has no interest in prosecuting the case.
4.
For these reasons, writ petition is dismissed for nonprosecution. No costs.
5. As a sequel, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
