THE HONOURABLE SRI JUSTICE J.SREENIVAS RAO WRIT PETITION No.23646 of 2014 ORDER:

This writ petition is filed seeking the following relief: "... to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 2nd Respondent in issuing No Objection Certificate (NOC) in respect of property situated in Sy. No.200 to an extent of Ac.5-00 at Anantaram Village, Bongir Mandal, Nalgonda District as illegal, arbitrary and against settled principles of Law and consequently, direct the 2nd respondent to issue No Objection Certificate (NOC) in respect of the above said property in favour of petitioner and pass such other order ..." 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing on behalf of respondents.

Learned counsel for the petitioner submits that the revenue authorities have granted assignment patta in favour of husband of the petitioner to an extent of Ac.5-00 in Sy.No.200 in the year 1969 and his name was mutated in the revenue records and his name was mutated in the revenue records and pattadar pass book and title deed were issued in his favour. Later the petitioner died on 10.07.2018 and thereafter, the petitioner has succeeded the subject property and her name was mutated in the revenue recoreds and pattadar pass book and title deed were also issued in her favour. The petitioner has submitted an application before respondent Nos.2 to 4 on 03.12.2012

requesting them to issue No Objection Certificate (NOC) for alienation of the subject land on the ground that she is facing several financial crisis. In spite of repeated requests made by the petitioner, respondent Nos.2 to 4 have not considered the representation to consider the claim of the petitioner without any reasons. The action of respondent Nos.2 to is contrary to law.

Learned Assistant Government Pleader for Revenue submits that, if the representation submitted by the petitioner dated 3.12.2012 is pending, respondent Nos.2 to 4 will consider the same in accordance with law and requested this Court to grant reasonable time.

In view of the above said submissions, without going into the merits of the case, the petitioner is granted liberty to submit F-line application through online for conducting survey and fixing the boundaries in respect of the subject land, within a period of four weeks from the date of receipt of copy of this order. On such application, respondent Nos.2 and 3 are directed to consider the same and pass appropriate orders in accordance with law, within a period of two (2) months thereafter.

With the above direction, the Writ Petition is disposed of accordingly. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
