This petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking to release the petitioner/accused No.5 on bail.

By order dated 14.06.2017, this Court directed the Registry to ascertain from the I Additional District and Sessions Judge, Rajamahendravaram, as to the stage of the case in S.C.No.31 of 2017. Pursuant thereto, the learned I Additional District and Sessions Judge, Rajamahendravaram, submitted his explanation vide letter dated 19.06.2017 informing the stage of NDPS S.C.No.31 of 2017 and this Court noted the contents therein. The reasons for not completing the trial in NDPS S.C.No.31 of 2017 (Crime No.29 of 2016 on the file of the P.S.Mothugudem, Rajahmundry) are that the accused took time to engage counsel and thereafter, he changed counsel and engaged a new counsel and thereafter, the Presiding Officer availed summer vacations and matter is to be disposed on or before 18.07.2017.

It appears, in respect of NDPS S.C.No.31 of 2017, schedule for trial was given from 20.06.2017 to 23.06.2017. In view of the fact that the trial in S.C.No.31 of 2017 is on the way and as the trial Court has time to complete it on or before 18.07.2017, there are no merits in this petition to grant regular bail to the petitioner/A5 at this stage.
