THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33149 OF 2017 ORDER:

Heard the learned counsel for the petitioner, learned Government Pleader for Municipal Administration (Telangana) appearing for respondent No.1 and Smt M.Bhagya Sri, learned Standing Counsel appearing for respondent No.2. 2.

The only grievance of the petitioner in the present writ petition is the alleged inaction on the part of respondent No.2 municipal authorities in considering the objections/ representations, dated 10.03.2017, 15.09.2017 and 22.09.2017 submitted against the building application made by the unofficial respondent herein on 16.11.2016 vide B.A.No.3015/W18/2016/0304.

The petitioner herein claims to be the absolute owner of the property covered by Survey No.680 of Jangaon Shivar, Markandeya Colony, Ramagundam Mandal, Peddapalli District having purchased the same by way of a registered sale deed, dated 08.02.2016. It is submitted by the learned counsel that the respondent authorities, without considering the objections raised by the petitioner herein, are going ahead and proceeding further with grant of building permission in favour of the unofficial respondent herein and if the same is permitted, the petitioner herein will suffer irreparable loss and hardship. 4.

Having heard the learned counsel for the petitioner and the learned Standing Counsel, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the

writ petition, directing respondent No.2 to consider the objections/representations, dated 10.03.2017, 15.09.2017 and 22.09.2017, said to have been submitted by the petitioner herein and to proceed further in accordance with law. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
