In view of the Letter dated 16.12.2016 submitted by the Appellant - Insurance Company and to that effect endorsement was made by learned counsel for the appellant on 23.12.2016 seeking permission of this Court to withdraw the appeal.

Permission is accorded and accordingly this Appeal is dismissed as withdrawn without costs.

As a sequel, miscellaneous applications pending, if any, in this Appeal shall stand closed.
