THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.15997 OF 2011 ORDER: (per SK,J) This writ petition was filed by the erstwhile State of Andhra Pradesh and the Commissioner, Greater Hyderabad Municipal Corporation (GHMC), Hyderabad, aggrieved by the order dated 08.03.2010 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1771 of 2007. The said O.A. was filed by the first respondent herein, a retired Additional Town Planner in the service of the GHMC, assailing the Charge Memo issued to him vide G.O.Rt.No.1119 dated 23.09.2002 on the ground that further continuance of the disciplinary proceedings pursuant thereto beyond four years was illegal. By the order dated 08.03.2010, the Tribunal accepted his plea and struck down the disciplinary proceedings. Interim suspension of the order under challenge was granted by this Court on 13.06.2011.

Sri K.Sita Ram, learned counsel representing Sri T.Surya Karan Reddy, learned counsel for the first respondent, would inform this Court that the first respondent expired about two years ago and even during his life time, the authorities did not choose to complete the disciplinary proceedings despite obtaining suspension of the order under challenge as long back as in the year 2011.

In the light of the aforestated facts, the cause in this writ petition no longer survives as it would not be open to the authorities to now continue with the said disciplinary proceedings.

The writ petition is accordingly dismissed. Interim order dated 13.06.2011 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. _______________ SANJAY KUMAR,J ______________ M.GANGA RAO,J Date:27.09.2018 GJ
