THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10238 of 2016 ORDER:

Heard Sri P. Govind Reddy, learned counsel for the petitioners, and Sri Ancha Panduranga Rao, learned Standing Counsel for the 2nd respondent - Municipal Corporation of Guntur. The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ, Order or direction declaring the action of the 2nd respondent in not paying the premium @ 6% to the petitioners for the months of May to August, 2015 even though the workers belonging to the petitioners have executed the sanitation work for the said period as illegal, arbitrary and unconstitutional and consequently direct 2nd respondent to pay the premium for the said period to the petitioners and pass such other or further orders as this Hon'ble Court may deem fit and proper."

It appears that the petitioners' made representation dated 09.03.2016 to the municipal authorities seeking redressal of their grievance in terms of the payments due to them and the said representation is still pending consideration. As the municipal authority concerned is yet to apply its mind to the said representation, this Court is not inclined to entertain this writ petition for the purpose of adjudication on merits. The writ petition is accordingly disposed of directing the Commissioner, Municipal Corporation of Guntur, Guntur, the 2nd respondent, to consider the petitioners' representation dated 09.03.2016 in accordance with law and take appropriate action thereon. In the event the petitioners' request for the payments due is rejected, the reasons therefor shall be duly recorded and communicated to them. This entire exercise shall be completed

expeditiously and in any event, not later than three (3) weeks from the date of receipt of a copy of this order.
