THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.1170 OF 2018 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed challenging the Order in S.R.No.23586 of 2017 in O.S.No.586 of 2008 passed by the Chief Judge, City Civil Court, Hyderabad, dismissing the Memo filed by the Defendant No.1 to set right the proceedings by recalling the Order eschewing the evidence of Pw.1 passed on 06.09.2017.

A memo is only an information to the Court and it is neither contemplated under Code of Civil Procedure nor under Civil Rules of Practice and no judicial Order can be passed on a Memo since it is an information to the Court, in view of the Judgment of this Court in Syed Yousuf Ali v. Mohammad Yousuf and others1.

Ac c ordingly, this Civil Revision Petition is dismissed as no judicial order can be passed on a Memo.

Miscellaneous petitions, if any, pending in this case shall stand closed.
