HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.10989 of 2009 ORDER:

Heard the learned counsel for the petitioners as well as the respondents.

The prayer sought in the writ petition is as under: "... Hon'ble Court may be pleased to issue a writ or order or direction more particularly one in the nature of writ of Mandamus by directing the respondents not to insist the petitioners to credit the amounts shown in the notices given to them vide Lr.No.H/SBHO/Misc/09 dated 09.02.2009 consequently quash and set aside the same being illegal arbitrary and against the principles of natural justice."

During the course of hearing, the learned Additional Standing counsel for the Central Government representing the respondents placed on record proceedings No.Tech/W.P.No.10989/2009, dated 31.10.2018. A perusal of the said proceedings would indicate that action was taken under Rule 16 of the Central Civil Services CCA Rules, 1965 and the sum of Rs.1,38,880/- was recovered from the officials and the agents. A copy of the said proceedings is made part of the record.

In that view of the matter, no further cause would survive in the present writ petition.

Accordingly, the writ petition is closed.
