THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10317 of 2013 ORDER:
The petitioner, who is A-1, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with Cr.No.60 of 2013 of Aspari Police Station, Kurnool District registered against him and others for the offences punishable under Sections 498-A r/w.34 IPC and Sections 3 and 4 of Dowry Prohibition Act. By an order 21-09-2013, this Court directed the petitioners 2 to 4 to surrender before the Investigating Officer within two weeks from that day and on such surrender, they were directed to be enlarged on bail on their executing personal bonds for a sum of Rs.5,000/- each with two sureties for a like sum each.
Insofar as this petitioner (A-1) is concerned, the matter was directed to be listed on 10-10-2013 and the investigating agency was directed not to arrest the petitioner till then. Further the learned Public Prosecutor was directed to secure the presence of the informant and the 1st petitioner was directed to be present before the Court on that day. Thereafter, the matter could not be listed. Today, when the matter is taken-up for hearing, learned counsel for the petitioner submits police have completed the investigation and filed charge sheet on 16-072014, but it was returned due to some technical objections.
Having regard to the circumstances stated above, the petitioner shall surrender before the concerned Court and move an application for bail after giving notice to the Public Prosecutor, in which event, the Court concerned shall deal with the same in accordance with law on the same day or at the earliest having regard to the fact that this Court granted interim relief. Accordingly, the Criminal Petition is disposed of.
