HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO Tr. C.M.P. No.328 OF 2015 ORDER:

The Tr.C.M.P. is filed to transfer F.C.O.P. No.74 of 2015 pending on the file of IV Additional District -cum- Family Court Judge, Kurnool to any Family Court at Hyderabad. 2) Heard both sides. Perused the material on record. 3) Though the scope under Order XXXIII Rule 3 CPC is limited, this Court is invoking Article 227 of Constitution of India in permitting the parties to compromise the matter pursuant to the terms of compromise from their presence and also reiterating the same in the affidavit filed in support of the petition, they arrived at consensus and entered into compromise voluntarily to bind themselves.

4) Accordingly and in the result, the transfer petition is disposed of in terms of compromise.

5) Consequently, pending miscellaneous petitions, if any, shall stand dismissed.
