HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims that his grandfather purchased the land to an extent of Ac.3.00 in Sy.No.125C of Unthakal Village, Bommanhal Mandal, Ananthapur District, from Sanna Timmappa by way of registered sale deed dated 06.05.1974. Later, it was gifted to the petitioner. Petitioner was granted pattadar pass books and has been in peaceful possession and enjoyment of the said land. Petitioner intended to dispose of the property. He came to know that his property is included in the prohibited list of properties under Section 22 (A)(1)(c) of the Registration Act, 1908 treating the said property as endowments property. In compliance with the directions issued by the Full Bench of this Court in W.A.No.343 of 2015 and batch dated 23.12.2015, petitioner submitted representation to the Commissioner on 18.06.2017 requesting to exclude the subject property from the list of prohibited properties. Alleging inaction on the said request, this writ petition is filed.

Since representation was already made and the same is pending consideration, this Court is not inclined to admit and kept the writ petition pending. Writ petition is disposed of, directing the Commissioner, Endowments Department, to examine the claim of the petitioner as ventilated in the representation dated 18.06.2017 and pass appropriate orders as warranted by law, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. It is needless to observe that in case
Commissioner is accepting the stand of the petitioner, consequential notification should be issued informing the registering authority deletion of the subject property from the list of prohibited properties.
