ORDER

This writ petition was filed challenging the action of respondent Nos.1 to 3 in not considering the representation of the petitioner dated 15.2.2012 with respect to regularization of plot bearing No.34, admeasuring 220 square yards in Sy.No.40 & plot bearing No.2, admeasuring 400 square yards in Sy.No.39 of Bandlaguda Village, Uppal Mandal, Ranga Reddy District. The petitioner in his representation dated 15.2.2012 stated that he is the absolute owner of plot No.3, admeasuring 400 square yards in Sy.No.39 of Bandlaguda Village, and he purchased the same under a registered sale deed dated 31.7.2996. He constructed a compound wall in the said land. While so, the 4th respondent, who claims to have purchased plot No.34, admeasuring 220 square yards and 5th respondent, who purchased plot bearing No.2, admeasuring 298 square yards on 28.8.

2009 & 20.7.2011 respectively, are trying to grab the property of the petitioner. It is further stated that respondent Nos.4 and 5 approached respondent Nos.1 and 2 seeking permission for construction of building and regularization of their plots and the petitioner requested the authorities not to take any action on their application. It is also stated that he filed O.S.No.2113 of 2011 on the file of the VII Additional Senior Civil Judge, against respondent Nos. 4 and 5 and the same is pending.

This Court by order dated 9.11.2012 directed respondents 1 to 3 to consider the representation dated 15.2.2012 of the petitioner and pass appropriate orders. But, till date, no orders have been passed. This Court also granted an order of status quo, as a result of which, no orders were passed in favour of respondent Nos. 4 and 5.

In view of the same, and keeping in view the present position of not passing any order in favour of respondent Nos.4 and 5, this Writ Petition is disposed of directing respondent Nos.1 to 3 to consider the representation & objection raised by the petitioner in the event of considering the building permission and plot regularization claimed by respondent Nos.4 and 5 and pass appropriate orders, in accordance with law, after issuing notice to the petitioner as well as respondent Nos.4 and 5. Accordingly, Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________________ JUSTICE A.RAMALINGESWARA RAO 20th December, 2016 rkk
