ORDER

This writ petition is filed seeking the following relief: "......to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent in suspending the petitioner from service vide impugned Proceedings Rc.No.

3770/E3E/2019 dt 8.3.2019 as illegal, arbitrary and unwarranted and consequentially the Hon'ble Court may pleased to declare that the petitioner herein is entitled for reinstatement into service by setting aside the impugned Proc dt 8.3.2019 with all consequential benefits and may pass such other order or orders as it may deem fit and proper in the circumstances of the case."

Heard Sri M.R.Tagore, learned counsel appearing for the petitioner, and learned Government Pleader for Medical and Health appearing for the respondents.

It is the case of the petitioner that he is working as Junior Assistant with the respondents. While so, the 1st respondent placed the petitioner under suspension vide proceedings dated 8.3.2019 on the ground that he has not reported to duty at State Health Transport Office, S.R.Nagar, Hyderabad.

Learned counsel appearing for the petitioner contended that though six months have elapsed, the respondents are not revoking the suspension order. It is prayed that appropriate orders be passed in the writ petition directing the respondents to revoke the suspension order dated 8.3.2019 strictly in terms of G.O.Ms.No.86, dated 8.3.1994 and pass appropriate orders. Learned Government Pleader appearing for the respondents contended that the case of the petitioner would be considered for revocation of the suspension order in terms of G.O.Ms.No.86, dated 8.3.1994 and appropriate orders would be passed.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for revocation of the suspension order in terms of G.O.Ms.No.86, dated 8.3.1994 and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
