THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23387 of 2017 ORDER:

This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the inaction of respondents 3 & 4 in disposing of Application No.3000063837, dated 26.02.2016, of the petitioner for regularization of Plot No.101, in Survey No.6 of Guttala Begumpet Village, Serilingampally Mandal, Ranga Reddy District, as illegal and arbitrary and contrary to G.O.Ms.No.151, dated 02.11.2015, and rules made thereunder and against to the principles of natural justice and consequently direct the respondents to regularize the petitioner's Plot by disposing the petitioner's application No.3000063837, dated 26.02.2016.

Heard the learned counsel for both the parties and perused the material available on record. With the consent of the learned counsel for both the parties, the writ petition is taken up for disposal at the stage of admission.

The case of the petitioner is that the petitioner purchased Plot No.101, admeasuring 600 square yards under registered Sale Deed bearing No.10385 of 2003 and in view of the Government Orders for regularization of unauthorized and unapproved layouts vide G.O.Ms.No.151, Municipal Adminsitration & Urban Development (M1) Department, dated 02.11.2016, the petitioner, in order to avail such benefit, submitted an application No.3000063869, dated 26.02.2016, for regularization of the subject plot of the petitioner to respondents

RE,J W.P.No.23387 of 2017 3 & 4, but so far, respondents 3 & 4 have not taken any action on the said application submitted by the petitioner and the same is pending.

When the matter is taken up, both the learned counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the application of the petitioner.

Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the respondent authorities to consider the application No.3000063869, dated 26.02.2016, submitted by the petitioner and pass appropriate orders, as warranted by law, as expeditiously as possible and communicate the decision to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ RAJA ELANGO, J Date: 14th July, 2017 KL
