THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.36853 OF 2015
O R D E R
With the consent of the learned counsel appearing for the parties, the writ petition is taken up for final disposal.
The grievance of the petitioners is that the respondent authorities are resorting to road widening and in that process interfering with their property bearing H.No.11-169, Gajwel, Medak District. Reference was made to G.O.Rt.No.301,
Transport, Roads and Buildings (R.II) Department, dated 10.07.2015 which embodies the decision of the State to undertake the road widening. Sri N.Praveen, learned counsel appearing for the fifth respondent Nagarapanchayat, states on instructions that the authorities are intending to take up the road widening work, but would do so strictly as per the due procedure. The petitioners placed on record the Gram Panchayat permission letter dated 14.06.2007 in relation to their property situated at H.No.11-169 in Sy.No.331/1 of Gajwel Village.
In the light of the aforestated facts and circumstances, the writ petition is disposed of directing the respondent authorities not to interfere with the possession of the petitioners over the subject property except in accordance with the due procedure laid down by law. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 12th NOVEMBER, 2015 PGS
