HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11205 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the 4th respondent in amending the entries with respect to the lands situated in Sy.No.418 of Narapala village and Mandal, Anantapuram District for an extent of Ac.2.50 cents in favour of 5th respondent without putting notice to the petitioners whose names were mutated and were also issued pattadar passbooks and title deeds as illegal and arbitrary and consequently to direct the 4th respondent to forthwith restore the entries in the revenue records to its original position. It is the case of the petitioners that they were issued notice dated 22.08.2016 by the 4th respondent for submitting the documents in respect of the land to an extent of Ac.2.89 cents in Sy.No.418-3 of Narpala Village & Mandal, Anantapuram District.

In pursuant to the same, petitioners submitted documents along with the application. In spite of the same, no enquiry was conducted and no orders are passed by the 4th respondent. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

In view of the facts and circumstances, without expressing any opinion on the merits of the case, the 4th respondent is directed to take appropriate action in pursuant to notice dated 22.08.2016, after issuing notice to the petitioners as well as 5th respondent, after affording an opportunity of hearing to both

parties, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
