THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2600 OF 2016 ORDER:

Heard the learned counsel for the petitioner/A.1 and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, by the petitioner/A.1 seeking enlargement on bail in Crime No.109 of 2015 of V.Madugula Police Station, Visakhapatnam District registered for the offence punishable under Section 20 (b) (i) read with 8 (c) of NDPS Act, 1985.

3. It is alleged that on 05.10.2015 at 5:30 hours, on information the Excise officials reached the outskirts of Satyavaram village fields and found A.1 and A.2 in possession of 100 kgs of Ganja in 5 gunny bags for the purpose of illegal transportation. Basing on this allegation, the present crime came to be registered.

4. Learned counsel for the petitioner submits that as the petitioner is in jail since 05.10.2015, his request may be considered on certain terms and conditions.

5. Learned Public Prosecutor opposed the same.

6. By an order, dated 10.02.2016 in Crl.P.No.1283 of 2016 this Court rejected the bail application of the petitioner.

7. Having regard to the nature of offence committed, the quantity of Ganja seized and as there are no changed circumstances either on facts or on law, I am not inclined to grant bail to the petitioner.

8. Accordingly, the Criminal Petition is dismissed.
