SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1836 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.1, in Crime No.15 of 2017 on the file of the Station House Officer, K.Kotapadu Police Station, Visakhapatnam District. 2.

The offence alleged is under Section 20(b)(1) R/w.8(c) of the Narcotic Drugs and Psychotropic substances Act, 1985 (for short, 'the NDPS Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

As per the case of the prosecution, 105 K.Gs of ganza was seized from accused Nos.1 and 2 together. The quantity of ganza seized from the accused is far beyond the commercial quantity. Hence, Section 37 of the NDPS Act does not permit grant of bail to the petitioner/accused No.1. 5.

Learned counsel for the petitioner, at this stage, brings to the notice of this Court that the wife of the petitioner was hospitalized on 17.06.2017 and got discharged on 26.06.2017. But, the same cannot be a ground for grant of bail to the petitioner.

Hence, this Court is not inclined to grant bail to the petitioner/accused No.1. Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
