THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.16056 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents. The petitioner is a fair price shop dealer of shop No.49 of K.Bathalapalli village, Kadiri Mandal, Anantapur District.

The authorization of the petitioner is valid up to 31.03.2015. While so, on 15.10.2014 the fourth respondent-Mandal Revenue Inspector, Kadiri along with his subordinates inspected the shop of the petitioner, conducted panchnama and seized the stock. The fourth respondent submitted a report to the third respondent-Tahsildar, Kadiri Mandal, who in turn forwarded the same to the second respondent-Revenue Divisional Officer, Kadiri on 15.10.2014. Based on such report, the second respondent issued a show cause notice on 18.10.2014 asking the petitioner to submit his explanation. The petitioner submitted his explanation on 25.10.2014. Without considering the explanation, the impugned proceedings were issued on 30.03.2015 suspending the dealership of the petitioner pending enquiry. Challenging the said proceedings dated 30.03.

2015, the present writ petition is filed. As the petitioner had already submitted his explanation on 25.10.2014 and as his dealership was suspended on 30.03.2015, this Court is not inclined to interfere with the order passed by the second respondent at this stage. However, the second respondent-Revenue Divisional Officer, Kadiri, is directed to consider the explanation submitted by the petitioner and conduct an enquiry in accordance with law and shall pass final orders after giving notice and opportunity to the petitioner and after observing principles of natural justice, within a period of 30 days from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed. No order as to costs.
