HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL NO.167 OF 2015 DATED:24.03.2015 Between:

Toka Samudralu and others.

...Appellants.

And The State of Andhra Pradesh, represented by its Secretary, Department of Irrigation, Hyderabad and others.

... Respondents.

THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL NO.167 OF 2015 JUDGMENT: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) After hearing learned counsel for the parties, we dispose of the appeal by the following judgment and order.

Admittedly a bridge has been constructed with the public fund. This has been done to sub-serve the need of the people of the locality. In the writ petition and in the appeal, it is highlighted, the location of the bridge is in such a position that it is not useful for each and every one of the locality. Actually in this sort of matter, Court cannot give any mandate. The Court can certainly take note of the fact that sufficient measures are taken for the benefit of the people at large, and if any suggestion is made, same may be entertained and looked into, so that the bridge is allowed to be used by all the people, and for that purpose, sufficient measures have to be taken by the Government. This must be done before the bridge is made operational.

The writ appeal is accordingly disposed of.

Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs. _______________ K.J. SENGUPTA, CJ _______________ SANJAY KUMAR, J
