THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8560 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A1 under Section 439 (1)(A) r/w.482 of Criminal Procedure Code seeking to relax the conditions of deposit of passport of the petitioner and also not to leave the limits of State of Telangana without prior permission of the Court, imposed in order, dated 20.05.2016, in Crl.MP No.753 of 2016 in CC No.502 of 2015 by the X Metropolitan Magistrate, Cyberabad at Makajgiri, and consequently permit the petitioner to leave the country. Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner is A1 in CC No.

502 of 2015 for the offences punishable under Sections 498-A and 506 IPC and 3 & 4 of the Dowry Prohibition Act and the Court below while granting bail to the petitioner directed him to deposit his passport and not to leave the limits of State of Telangana without prior permission of the Court below. He further submits that the petitioner is working in Australia and he has to join his job otherwise, he may lose his job and hence, his passport may be directed to be returned and also permit him to leave the country. Learned Public Prosecutor objected this application on the ground that the in case the petitioner is allowed to leave the Country, he may not appear before the trial Court.

Considering the submissions of both the learned counsel and also on perusal of record, this Court is inclined to pass the following order: The Court concerned is hereby directed to return the passport of the petitioner forthwith and the petitioner is permitted to leave the country. The petitioner is further directed to represent his case before the Court below through any one of his relatives.

With the above directions, this Criminal Petition is disposed of. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J June 24, 2016.
