THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.43797 OF 2016 ORDER:
This Writ Petition is filed seeking to declare the action of respondents in seizing the lorry bearing registration No.AP-26-Y2999 belonging to the petitioner, as illegal and arbitrary. The case of the petitioner is that his lorry bearing registration No.AP-26-Y-2999 was seized on 08/09.12.2016 on the ground of violation of the provisions of the Essential Commodities Act, 1955 (for short, 'the Act') and he made a representation for release of the said lorry. As no orders passed yet on the said representation, the present Writ Petition is filed.
Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
No useful purpose will be served in keeping the vehicle idle pending enquiry under Section 6-A of the Act and the same will get spoiled.
In view of the same, respondent No.2 is directed to release the said lorry to the petitioner, pending enquiry under Section 6-A of the Act, on furnishing security to his satisfaction within a period of two weeks from today.
With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 16, 2016.
