HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2355 OF 2009 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 2 and 3 in stipulating the minimum required quantity for VRCC as 980 instead of 470 for VRCC 125 MM 4830 instead of 2354, steel 155 instead of 63 flooring 6266 instead of 27-6 and brick work 1071 instead of 524 in Tender Notification IFB No.F1/1688/06-01, dated 28.01.2009, as illegal and arbitrary and violation of conditions contained in G.O.Ms.No.94 I & CAD, dated 01.07.2003 and for a consequential direction to the respondents to take into account for VRCC 470, VRCC 12MM 2354, Steel -63, Flooring 2706 and Brick work 524.

At the time of admission on 10.02.2009, this Court granted interim direction to the respondents to accept the tender of the petitioner subject to its eligibility, as per law. Further the tenders if any accepted, shall be subject to further orders in this petition. In view of the aforesaid interim order, nothing survives for adjudication in this writ petition. As such, the writ petition is disposed of in terms of the interim order passed by this Court in WP.MP.No.2991 of 2009 on 10.02.2009. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
