THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9104 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 and 2 in Crime No.1054 of 2022 pending on the file of Station House Officer, Medipally Police Station, Rachakonda Commissionerate registered for the offences punishable under Sections 498-A and 306 of Indian Penal Code (for short IPC).

Heard learned counsel for the petitioners/Accused Nos.1 and 2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioners is that the 1st petitioner married the deceased two years prior to the complaint. The petitioners are working and they started harassing the wife of Accused No.1 physically and mentally suspecting her character while she was talking to any other person and did not allow to talk on phone. Ultimately on 21.09.2022 the deceased consumed acid resulting in her death. For the said reason, the petitioners were arrested and remanded to judicial custody on 23.09.2022.

As seen from the remand report, the only allegation against these petitioners is that they were suspecting the character of the deceased. Apart from the said allegation, there are no other allegations made. Since the petitioners are in jail since 23.09.2022, they can be granted the relief of regular bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 and 2 are granted bail subject to the following conditions:

i) The petitioners/Accused Nos.1 and 2 are directed to be released on bail on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties each for a like sum to the satisfaction of Principal Junior Civil Judge-cum-IV Additional Metropolitan Magistrate, Malkajgiri District, Uppal at L.B.Nagar.

ii) After release on bail, the 1st petitioner/Accused No.1 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.

iii) The 2nd petitioner/Accused No.2 shall appear before the investigating authorities as and when required for the purpose of investigation.

iv) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 26.10.2022 ns
