THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.517 of 2016 ORDER:
This Criminal petition is filed by the petitioner-accused aggrieved by the order dated 12.3.2014 passed in Crl.R.P.No.31 of 2014 whereby the learned Metropolitan Sessions Judge, Hyderabad dismissed the revision confirming the order passed by XIX Additional Chief Metropolitan Magistrate, Hyderabad in Crl.M.P.No.2332 of 2013 in C.C.No.16 of 2012 dated 10.12.2013 dismissing the petition filed by the petitioner seeking to send the cheque in question to the expert for comparison of the signature and the other writings of the cheque. Now, the learned counsel for the complainant-second respondent herein informed that the trial in C.C.No.16 of 2012 itself is completed and the petitioner herein is convicted and the petitioner has also preferred an appeal before the competent court.
In view of the above the Criminal Petition is disposed of granting liberty to the petitioner to prefer an application before the appellate Court where the appeal is pending, for sending the cheque for expert opinion, if he is so advised and the appellate Court shall decide the said issue in accordance with law. Miscellaneous petitions pending, if any, shall stand closed. ________________________ JUSTICE RAJA ELANGO 04th April, 2016.
