SMT JUSTICE T.RAJANI CRIMINAL PETITON No.1858 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is sole accused, in Crime No.22 of 2018 on the file of Ghatkesar Police Station, Rachakonda. The offences alleged are under Sections 406, 411, 420, 379 of IPC and Section 7 of Essential Commodities Act.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The allegations against this petitioner are that he was selling adulterated kerosene, which is meant for public distribution. The said kerosene was found in the premises of the petitioner. 4.
Hence, in view of above facts, this court opines that this is a not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed. However, in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.

As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
