HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7621 OF 2017 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/ party No.1, seeking to quash the proceedings in Crime No.258 of 2017 on the file of the Khammam Rural Police Station, Khammam District, registered for the offences punishable under Section 107 Cr.P.C.
Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State and perused the grounds in the Criminal Petition.
Though the question of registering of crime does not arise, it is practically the report forwarded to the Executive Magistrate to initiate proceedings under Section 107 Cr.P.C. Having regard to the above, there is nothing to quash the proceedings, but for, the petitioners are entitled to file application under Rule 37 of the Criminal Rules of Practice for one to represent other two groups before the Executive Magistrate to participate in enquiry to decide on own merits.
