HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.461 of 2017 ORDER :

The present petition is filed on the ground that the III Additional District Judge, Guntur erred in issuing notice instead of granting interim injunction as prayed for, in I.A.No.1306 of 2016 in O.S.No.408 of 2016. Learned counsel appearing on behalf of petitioner submits that the petitioner/plaintiff filed suit for specific performance, however, before passing the decree in O.S.No.408 of 2016, the petitioner filed application for the direction thereby to direct the respondents not to alienate or create third party interest over the suit property. However, the said application has not been decided till date and is being adjourned on one pretext or the order. Keeping in view the averments made in the petition and the submissions of counsel for petitioner, I hereby direct the III Additional District Judge, Guntur to decide I.A.No.

1306 of 2016 in O.S.No.408 of 2016 within four weeks from receipt of this order. In view of above, the revision petition is disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed.
