ORDER:

This writ petition is filed praying to declare the action of the 1st respondent in not issuing 'Standard Clearance/No Objection Certificate' for sale of electricity from the petitioner's Co-generation Plant to IEX through Short-Term Open Access for the period from 01.03.2019 to 31.03.2019 based on the application made on 23.02.2019 is illegal and arbitrary.

According to the learned standing counsel, on 23.03.2019 orders are passed granting such NOC, valid till 31.03.2019. According to learned counsel for petitioner, earlier also permission was granted, but each time it was granted only for one week. However, since period in issue is only from 01.03.2019 to 31.03.2019 and NOC is granted for this period, cause in the writ petition does not survive. Writ petition is accordingly dismissed. However, this order does not come in the way of petitioner to work his remedies if he is aggrieved by granting NOC on weekly basis for further period also. Pending miscellaneous petitions shall stand closed.
