THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2681 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.1 to A.3 under Section 482 Cr.P.C., to quash the proceedings in Crime No.43 of 2016 on the file of S.H.O., Police Station, Central Crime Station, Hyderabad for the offences under Sections 406, 420, 120-B r/w Section 34 IPC. Heard.

On perusal of the entire material available on record, prima facie there are some allegations as against the petitioners herein and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at the threshold. At this stage, learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners apprehend arrest and also harassment in the hands of the police.

In view of the fact that the crime is arising out of some land dispute between the parties during the course of transaction of sale of flats, this Court is of the view that the case can be investigated without arresting the petitioners since the entire case is based on documents. Hence, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law. The petitioners are directed to appear before the investigating agency as and when required and cooperate with the investigating agency. They are at liberty to produce the relevant documents to substantiate their claim that they have not committed the offences as alleged. Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
